Transition and Unfair Commercial Practices, Risks and Benefits of the EU Proposal

On 23 March, the European Commission submitted to the Parliament and the Council for their consideration the proposal for Directive No. 85/2023, aimed at combating the use of unfair commercial practices (UCP) in terms of environmental sustainability. The text, in addition to being articulated in its contents, is especially important from a symbolic point of view, confirming Brussels' concrete interest in defining the problem of greenwashing and identifying the most effective measures to combat and prevent it. Proposal No. 85/2023 (which has become part of a true "anti-greenwashing" package that also includes proposal No. 92/2022 drafted and presented by the E.C. itself in March 2022) has as its central objective precisely "the empowerment of consumers for the green transition" and the introduction into the list of practices considered unfair of certain conduct such as the dissemination of declarations on environmental performance whose excellence cannot be demonstrated, or of environmental declarations that are excessively generic or partial.
