Repechage is not mandatory if the worker is inadequate to the new position – Developments and extensions in restricted areas

In the case of dismissal on justified objective grounds, the employer must prove that he cannot assign the redundant employee to other equivalent, or even lower, duties (so-called “repechage” obligation).

The penalty applicable to developments made in the absence of authorizations in an area subject to landscape restrictions should be established depending on whether it is a volumetric extension of an existing building or a new construction and subject to assessment of the volumetric variation.
