The reorganization and review of the system of liens – Illegitimate sanctions under Legislative Decree no. 28/11

According to art. 1 of Bill no. C.3671bis/S.2681, currently under the Senate’s review, and containing the "Delegation to the Government for the consistent reform of the laws and regulations on corporate distress and insolvency", the Government is expected to proceed with the reorganization and revision of the system of liens.
In its ruling dated 10.03.17, the Constitutional Court declared illegitimate those articles of Legislative Decree 28/11 providing for significant penalties at the charge of those who provide untrue documents or make false statements to obtain incentives.
