A review of the principles upheld by the Italian Supreme Court (5th Section) in its judgments no. 32840, 32841 and 32842, whereby its case law resumed an issue that through the times has been giving rise to interpretation uncertainties, such as on the identification of the “beneficial owner” for contractual purposes.
