The special moratorium agreement – Review of the advanced payment instalment for facilities under incentive programmes – Transformation of private areas into public works

As part of debt restructuring transactions, recourse to the new “special” moratorium agreement, introduced by Law no. 132 of 6 August 2015 into the insolvency legislation.
The value of the instalment payment, starting from July 2017, is to be reviewed based on the production hours of individual facilities.
According to Judgment no. 3005 of 21st June 2017, the Sixth Section of the Council of State confirmed and further outlined an important principle on the matters of occupation by public bodies of private land and its consequent irreversible transformation to public use in the absence of expropriation procedure.
