With judgement of 8 September 2022 (case C-399/21), the CJEU ruled on the jurisdictional competence for cross-national disputes regarding ownership of inventions by employees. It stated that art. 24 from the Brussels I bis Regulation, under which the judges of the Member State in which territory the patent is granted have exclusive jurisdiction over the disputes on the registration and validity of the patent, regardless of the domicile of the parties, is inapplicable to such inventions.
