EU Court of Justice agrees with CBA in Jamendo's case against the SIAE and LEA duopoly
CBA, with a team composed by Mattia Dalla Costa, Alessia Ferraro, Anna Iorio and Giulia Cipriani, is assisting the client JAMENDO - a Luxembourg-based company that manages the homonymous web platform distributing and licensing musical works of independent authors and artists - in a case against the Italian association LEA - Liberi Editori e Autori, a collective management organisation that together with the former monopolist SIAE carries out in Italy the intermediation of copyright on musical works.
The Case was decided by the European Court of Justice with a ruling published on 21 March 2024 that completely changed the rules on who manages and collects copyright in Italy and the European Union, putting a definitive end to the (few) monopolies still existing in this sector, including the SIAE-LEA duopoly still existing in Italy and the Austrian monopoly.
