In Judgment No. 4741 of Feb. 15, 2023, the Supreme Court ruled that when in the course of the trial, in which a right pertaining to a Mutual Fund is disputed, management relationships relating to the Fund are transferred from one management company to another - pursuant to Art. 36, para. 1 of Legislative Decree 58/1998 - the trial continues between the original parties.
