ECJ: Non-deductibility of interest expense on loans related to investments held under the “Parent-Subsidiary” Directive to be reduced

Analysis of the Judgment rendered on 26 October 2017 by the Court of Justice of the European Union (ECJ) in case C-39/16, where a rule of domestic law, which provides for the non-deductibility of interest expenses on loans incurred by a parent company up to the amount of exempt dividends paid to the same company, is declared to be in contrast with EU regulations on taxation of corporate profits under the “Parent-Subsidiary” Directive.
