Bank guarantees: omnibus guarantee between nullity and refund

Tribunale di Milano (Court of Milan) – ruling No. 2637/2020 – addresses once again the thorny issue of the possible nullity of the omnibus guarantee in favor of bank transactions, when it closely follows articles 2, 6, and 8 of ABI’s model forms drafted in 2002. As it is well known, these were censored by Banca d’Italia measure No. 55 of 05/02/2005, as being potentially opposed to antitrust regulation.
