In a recent order (Cass., sez. lav., no. 19023 of 5 July 2023), the Court of Cassation affirmed that when the employee's home is merely the place where the smart working service is carried out, without any other element (or objective/subjective connection) characterising the home as a company dependency, then it cannot be taken into consideration as a criterion for the purposes of identifying the territorial jurisdiction of the Employment Tribunal.
