Ability of bridge-institutions to defend in trial: the Court of Appeal overturns the conclusions of the Court of Milan’s Business Section

In its ruling no. 917/2019 published on 28 February 2019, the court of appeal of Milan took a stance on the complex issue of the ability to defend in trial for those bridge-institutions acting as transferees pursuant to legislative decree no. 180/2015, and fully reformed the court of Milan’s previous ruling no. 11173 issued on 8 November 2017.
