Implied possessory right and burden of proof: a missed opportunity for an 'objective' confrontation

The purpose of this contribution is to investigate, or at least offer some food for thought, on a case that, not so uncommon in commercial practice, underlies the application of a civil law institution that is a cornerstone of our system, the configuration of which has been the subject of debate for more than a century and which, for our purposes, has an incisive effect on the burden of proof.
