Public procurement: EU principles continue to be mandatory, even in the emergency phase

The principles regulating the award of public works contracts, public supply contracts and public service contracts under EU legislation on the one side, and the criteria on procedura negoziata d’urgenza “negotiated procedure without prior publication in situations of urgency”, provided for in the national regulation under art. 63, para. 2, lett c) of the Codice dei Contratti Pubblici (Italian public procurement code) on the other side, continue to be crucial. The above principles and criteria define the frame of reference, also in the current emergency scenario, for Administrations awarding public contracts – although active. Public entities shall ensure compliance with the principles of competition, transparency, and openness, notwithstanding Covid-19 health crisis.
