Fair grounds for dismissal of overly authoritative manager – The transposition of the AIFM directive and the financial instruments for the Italian real estate sector

The Court of Milan, in its judgment no. 472 of 23.03.17, ascertained the legitimacy of the dismissal of a manager who, despite achieving important company results, managed the company with an authoritarian and self-referential style.
EU Directive 61/2011 was implemented in Italy through Italian Legislative Decree n. 44/14. The provision at issue involves, among other things, substantial changes to financial instruments applicable to the real estate sector.
