Lawful dismissal on disciplinary grounds – Use of patronymics: the real descriptive requirement as a legitimation criterion –Real estate funds in the disposal of Italy state-owned assets
In the Italian legal system, an employer may order a dismissal on fair grounds whenever an employee implements such serious actions as to not allow the continuation of the employment, on a neither permanent nor temporary basis.
In its ruling no. 10826 of 25.05.16, relating to the dispute pending between designer Elio Fiorucci and the purchaser companies of his “Fiorucci” word marks, the Supreme Court ruled on the matters of patronymic brand.
With several interventions occurred over time, Italian lawmakers have traced a path that identifies the need for valorisation, management and disposal of state-owned real estate properties, and identified real estate alternative investment funds as suitable operational instruments to pursue the envisaged purposes.
