The use of AI systems in public administration requires particular caution, given its neutral role in serving the public interest. This is why the precautionary principle has traditionally played a dominant role—almost becoming the structural foundation for AI regulation.
However, as a framework for managing uncertainty, a strict application of this principle risks leading to excessive precaution, significantly slowing the adoption of new algorithmic technologies. A balanced approach is therefore essential, ensuring that precautionary measures remain proportionate and effectively reconcile the need for innovation with the imperative of protection.
