Workshop D2:Do’s and don’ts in the protection of trade secrets and transfer of know-how on cross border transactions: a practical overview
Businesses use confidentiality as a business competitiveness and research innovation management tool. Small and medium-sized enterprises value and rely on know-how and trade secrets even more than on patents but do not always fulfil the compliance conditions in order to obtain a protection in Court.
Collaborative research, including cross-border cooperation, entails dissemination of knowledge which exposes to dishonest practices, such as theft, unauthorised copying, economic espionage or the breach of confidentiality requirements.
The Yokohama meeting will be the first international LES meeting following the different national implementation of the EU Directive on Trade Secrets in the European States.
A case study of international transactions in Japan, the EU, USA and Israel, will give a mix of in-house and attorney’s viewpoints and useful guidelines on how to avoid (but also in the remedies available in case of) unlawful acquisition, use or disclosure of trade secrets by employees and competitors.
