The repair clause under the new industrial design framework

The European reform of industrial design law reshapes the scope of the repair clause by introducing a more restrictive approach and limiting its application to cases where the replacement component is aesthetically dependent on the complex product into which it is incorporated. This results in a narrower opening of the spare parts market, with significant implications for competition and consumer choice, while introducing new transparency obligations for independent manufacturers.
