The European Commission’s objections to project financing under the new Public Contracts Code

The European Commission has reopened infringement proceedings against Italy over the project-financing framework set out in Article 193 of the Public Contracts Code. According to the Commission, the Italian system is not fully aligned with EU directives and may undermine key principles of transparency, equal treatment, and competition in the award of concessions. Italy will now be required to address the Commission’s concerns or consider further amendments to the Code.
