Greenwashing Decree: EU crackdown on green claims reaches Italy

The draft “Greenwashing Decree”, recently approved at a preliminary stage, implements Directive (EU) 2024/825, strengthening consumer protection in the green transition and tackling unfair commercial practices.
Key measures include a reversal of the burden of proof, the introduction of automatically unfair practices, and enhanced enforcement powers for the Italian Competition Authority. The draft decree also establishes a structured framework for the classification of sustainability-related claims.
