Building on an editorial project launched more than a decade ago, the firm's Fund Formation and Real Estate team has published the fifth edition of its Handbook on Real Estate Alternative Investment Funds (AIFs). The publication brings together and systematises the principal legislative and regulatory provisions, the guidance issued by the competent authorities, relevant market practice and the most significant case law concerning real estate alternative investment funds (AIFs).
The Handbook is published against the backdrop of a continuously evolving regulatory framework, characterised by the ongoing refinement of the rules governing collective investment schemes and by the extensive interpretative activity of the supervisory authorities. In light of the most recent legislative developments, the firm is already preparing a further update to the Handbook, which will reflect the latest regulatory changes affecting market participants.
The publication follows an alphabetical, topic-based structure designed to facilitate consultation of the key legal and regulatory issues relevant to the sector.
In addition to regulatory and corporate law aspects, the Handbook examines the principal tax issues affecting real estate AIFs, together with the interpretative questions that continue to shape the market.
Among the topics covered are a number of issues of continuing practical importance, including the definition and legal status of real estate AIFs, the liability of fund managers, the corporate and insolvency law implications of fund management and liquidation, and the tax aspects that, despite the relative stability of the legislative framework, continue to give rise to interpretative debate.
The Handbook also includes a comprehensive review of the most significant court decisions that have contributed to the development of the legal framework and market practice applicable to real estate AIFs, providing readers with a comprehensive overview of this evolving area of law.
