The Court of Cassation has annulled the “Zara” trademark registered by FFAUF Italia S.p.A. for food products, upholding Inditex’s claim to extend the protection of its mark beyond the fashion sector. The ruling reaffirms the protection afforded to well-known trademarks against freeriding and undue exploitation, safeguarding the brand extension strategies of major corporations.
